How to obtain the environmental license

Law 20/2009, on prevention and environmental control of activities

On December 11, 2009, the law on prevention and environmental control of activities was published. This law entered into force on August 11, 2010, and regulates the process of obtaining the environmental license for the different economic activities. Specifically, the law establishes 5 different regimes for administrative intervention: the Environmental Authorization with an Environmental Impact Statement, the Environmental Impact Statement with Substantive Authorization, the Environmental License with Prior Decision on the Impact Statement, the Environmental License and the Environmental Communication .

The Environmental Authorization with Environmental Impact Statement

Examples of activities that require an Environmental Authorization with an Environmental Impact Statement are the following: electric power production plants through combustion processes with a power of more than 50 MW, refineries, automobile factories with a surface area of more than 30,000 m2 and theme parks with a surface area of more than 20 hectares, among many other activities.

Environmental Impact Statement with Substantive Authorization

Examples of activities that require an Environmental Impact Statement with Substantive Authorization are the following: Wind farms that have more than 5 wind turbines, with a power greater than 10 MW or that are located less than 2 km from another wind farm ; Photovoltaic installations with a surface of more than 6 hectares and which are located on undeveloped land, as well as extractive activities, among others. Environmental License with Prior Decision on the Environmental Impact Statement

Any activity with a relatively low environmental relevance and that intends to be implemented in protected areas declared in the PEIN, in wet protected areas or that are included in the Natura 2000 Network, must be subject, at least, to the environmental license regime with decision prior on the environmental impact statement.
